well he was filling a whole and sounds like he didnt have the correct PPE, was the hole covered with some kind of obstruction? was it also slippy in nature?, was he wearing a hard hat? and saftey shoes :-), if none of the above PPE wasnt given and no record of this being signed for then indeed theres a claim to be made,

is there any cctv of the accident?,
